# Ohio Move Over: stopped vehicles, safe lane changes and speed

Recognize Ohio’s covered roadside vehicles, decide when to change lanes and slow safely when moving over is impossible.

- Español: Move Over en Ohio: vehículos detenidos, carriles y velocidad segura

### Article — English

A stopped roadside vehicle with warning lights can put workers only a few feet from moving traffic. In Ohio, begin the response early: **look ahead, identify the stopped scene, check the next lane and create space safely**.

## Recognize the vehicles covered by the law

[Section 4511.213](https://codes.ohio.gov/ohio-revised-code/section-4511.213) applies when approaching a stationary vehicle in these categories displaying the legally prescribed flashing, oscillating or rotating warning lights:

- Public-safety and emergency vehicles, such as police or fire vehicles.
- Road-service vehicles, such as a tow truck working at a breakdown.
- Waste-collection vehicles.
- Highway-maintenance vehicles.
- Public Utilities Commission vehicles conducting the specified motor-vehicle inspections.

Check the scene rather than looking only for a police cruiser or blue lights. A tow operator or maintenance worker can be just as close to your lane. The [Highway Patrol’s Move Over guidance](https://content.govdelivery.com/accounts/OHOSHP/bulletins/4056a0d) emphasizes roadside workers as well as first responders.

## Use the available lane safely

When your highway has **at least two lanes carrying traffic in your direction**, proceed cautiously and, when possible with regard to traffic, road and weather conditions, move to a lane **not adjacent to the stopped vehicle**. Check mirrors and blind spots, signal and establish a safe gap. The instruction does not authorize cutting off another vehicle or making a sudden swerve.

On a two-lane road with one lane each way, the oncoming lane is not a second lane in your direction. Do not force your vehicle across the center line to imitate a freeway lane change.

If the road lacks another same-direction lane, or changing lanes is impossible or unsafe, **reduce speed and maintain a speed safe for the traffic, road and weather conditions**. The statute does not specify a universal “20 mph below the limit” rule or a fixed passing speed. A posted limit is not a target to maintain beside a hazardous roadside scene.

| Situation | Practical response |
| --- | --- |
| Tow truck on the right shoulder; left lane safely available | Move left with adequate clearance and continue cautiously |
| Police vehicle on the shoulder; adjacent lane occupied | Slow down, stay controlled and pass at a safe speed; do not force a merge |
| Maintenance vehicle beside a one-lane-per-direction road | Reduce speed and proceed cautiously within a safe path |
| Heavy rain or poor visibility | Allow more time and space; assess whether a lane change is safe |

## Give other disabled vehicles room too

The current section lists the categories above; it does not say that **every private disabled car becomes a covered vehicle merely by switching on hazard lights**. A person changing a tire or a child beside a stranded car still needs room. As a safety practice, slow down and move away when a safe legal lane change is available, while continuing to watch for people, debris and opening doors.

If a tow truck or emergency responder arrives, assess the protected vehicle and its warning lights rather than assuming the original disabled car defines the whole scene.

## Distinguish a stopped scene from an approaching emergency vehicle

A moving emergency vehicle approaching with the required warning lights and audible signal invokes the yielding rule in [section 4511.45](https://codes.ohio.gov/ohio-revised-code/section-4511.45): yield, move as close as practical to the right edge clear of an intersection, and stop until it passes, unless a police officer directs otherwise. That is a different action from passing a stationary roadside scene.

Keep attention on driving after you pass: do not photograph the incident or look back at it. Return to your normal lane only when safe. Review the [school-bus stopping guide](/oh/blog/oh-school-bus-stopping-rules) for another situation where the required stop depends on the scene and direction.
